Mars Platform, LLC – Terms of Service

1. Introduction
Welcome to Mars Platform. These Terms of Service (“Terms”) govern your access to and use of the Mars Platform and its related websites, including but not limited to MarsPlatform.com, MartianExchange.com, MarsAIGPT.com, AdGalactic.com, and any affiliated websites, applications, programs, forums, and services (collectively referred to as the “Services”). Mars Platform, LLC (“Mars Platform,” “we,” “us,” or “our”) owns and operates these Services, designed to support user-driven content sharing, trading, and social engagement. By accessing or using the Services, you agree to be bound by these Terms.
These Terms represent an agreement between you and Mars Platform, LLC. Please review them carefully.
2. Who May Use the Services
You may use the Services only if you agree to form a legally binding contract with us and comply with these Terms and all applicable laws. You must be at least 18 years old to use the Services, especially for trading purposes. If you represent a company, organization, or other legal entity, you warrant that you have the authority to bind that entity to these Terms, in which case “you” and “your” refer to that entity.
3. Privacy
Our Privacy Policy (https://marsplatform.com/privacy-policy/) outlines how we collect, use, and share information when you use our Services. By using the Services, you consent to the processing of your information in accordance with this policy.
4. Content on the Services
User-Generated Content: You are responsible for all content you post, upload, or share on the Services (referred to as “Content”), including text, graphics, videos, links, and comments (“Buzz”). By submitting Content, you affirm that you have all necessary rights to grant the following license to us.
License to Mars Platform: By posting Content on or through the Services, you grant Mars Platform a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, reproduce, process, adapt, publish, and distribute your Content in all media or distribution methods. This license allows Mars Platform to operate and promote the Services, including making Content available to other users, partners, and third parties.
Responsibility for Content: You retain ownership of your Content, but by posting on Mars Platform, you agree to allow us to monetize, display, and share it across various channels. You are solely responsible for your Content and any consequences of sharing it, including any copyright, trademark, or other legal issues that may arise. You agree not to upload any third-party Content without full consent from the rightful owner.
Content Removal: Mars Platform reserves the right to remove or limit visibility of Content that violates these Terms, our Privacy Policy, or any applicable laws. Content found to be in violation may be removed without prior notice. If you believe your rights are infringed, please report it via our contact page at https://marsplatform.com/contact/.
5. Using the Services
Prohibited Conduct: You agree to use the Services only in compliance with these Terms and all applicable laws. You may not:
– Interfere with or disrupt the Services.
– Circumvent, disable, or otherwise interfere with security features.
– Access the Services by any means other than the provided interfaces.
– Engage in unauthorized automated processes, such as scraping or crawling the Services without explicit permission.
– Attempt to gain unauthorized access to any portion of the Services, our systems, or user accounts.
Trading Content: The Martian Exchange within the Mars Platform allows users to trade Content in a stock-like model. Users can buy, sell, or hold Content within 30 specialized “trading stocks” covering various categories, with hourly ten days price movement updates, and a 90-day expiration on each trade. All users must adhere to the rules posted on our trading guidelines page and comply with all Stripe and applicable payment processing requirements.
User Account Responsibility: To access certain features, you may need to create an account. You are responsible for safeguarding your account credentials and must promptly notify us of any unauthorized use. We cannot be held liable for any loss resulting from your failure to protect your account information.
6. Eligibility for Services
Mars Platform services are available only in specific countries. A full list of supported countries is available [https://marsplatform.com/supported-countries]. If you reside in an unsupported country, you are not permitted to register, trade, or charge Buzz Posts. We reserve the right to update the list of supported countries at our discretion.
7. Restriction of Access
Users residing in countries not listed in our supported countries page are prohibited from accessing or using Mars Platform’s services. Attempts to circumvent geographic restrictions, such as through VPNs or proxy services, may result in account suspension or termination.
8. Updates to Supported Countries
The list of supported countries may change over time as we expand our services. Any changes will be reflected on the [https://marsplatform.com/supported-countries], and it is the user’s responsibility to verify availability in their region.
9. Refunds for Unsupported Regions
If you register or make a transaction from an unsupported country, you may be ineligible for a refund or reversal of charges. Please ensure your country is listed on the [https://marsplatform.com/supported-countries] before proceeding.
10. Monetization and User Rights
User License: Mars Platform grants you a personal, non-exclusive, non-transferable license to use the Services solely as permitted by these Terms. You retain ownership of any Content you post. However, by posting on Mars Platform, you provide us a license to use, distribute, and monetize your Content without further permission or compensation to you, as agreed herein.
Advertising and Paid Services: Mars Platform, or our partners, may place advertising on the Services, with no obligation to compensate you. If you choose to use any paid features of the Services, you agree to the Terms for Paid Services, which become part of this agreement.
11. Trade Agreements and Contractual Terms
Definition of Charges and Trades
Every charge or trade conducted on the Mars Platform represents a binding contractual agreement between the user (creator or trader) and the platform. These agreements govern the terms of revenue generation and participation, ensuring fairness and transparency.
50% Cash Settlement Trades
1. Single Contract Rule: Each trade must be purchased individually. Every trade operates as a separate contract, and payouts are calculated on a per-contract basis.
2. Multiple Contracts Limitation: If multiple contracts are purchased simultaneously, the system will only process payouts for “one contract” per transaction batch. To ensure maximum returns, users are advised to purchase “one trade at a time” under this option.
3. Guaranteed Payouts: Traders engaging in 50% cash settlement trades will receive fixed commissions of 50% of the trade value, payable from day one up to 90 days, in accordance with the contract terms.
4. Monthly Access Subscription Requirement
Every user trading content on the Mars Platform must purchase a “Growth Charge” monthly access subscription to maintain an active trading account.
12. Trade-Based Charge Requirement
Two types of charge:
Growth Charge: Is a $25.00 monthly access subscription.
Elite Charge: Is an operational $100.00 charge every 25 completed trade.
For every 25 trades completed, the user must purchase an additional “Elite Charge” before continuing further trading.
This ensures a continuous cycle of new content entering the trading ecosystem, maintaining engagement and earning potential.
13. Fee Structure
By using our platform, you acknowledge and agree to the following fee schedule:
1. Charge Fee: $3.00 (Any applicable processing fees charged by Stripe will apply)
2. Trade Fee: $5.00 per trade conducted on the platform.
3. Fund Transfer Between Users: $3.00 per transaction.
4. Top-up Fee: $0.00; however, any applicable processing fees charged by Stripe will apply and must be borne by the user.
5. Withdraw Bank Transfer Fee: $0.00; any applicable processing fees charged by Stripe will apply and will be deducted from the user’s wallet account.
Stripe Payment Gateway Fees
In the event Stripe imposes additional fees for transactions (e.g., processing, service fees), the user agrees that these charges will be deducted directly from their wallet account balance at the time of processing.
Amendments
The platform reserves the right to revise these fees at its sole discretion. Users will be notified of such changes through updates to the Terms of Service or via email notification, as applicable. https://marsplatform.com/fees/
14. Wallet Minimum Balance Requirement
1. General Policy:
Users are required to maintain a minimum wallet balance to ensure account functionality and access to trading and transferring features.
Accounts initial balance value: $500. (Every account must start with a balance of $500.)
Accounts with a total trade value of up to $1000: Minimum balance of $100.
Accounts with a total trade value between $1001 and $5000: Minimum balance of $250.
Accounts with a total trade value exceeding $5000: Minimum balance of $500.
2. Grace Period for New Users:
New accounts are eligible for a 30-day grace period where the minimum balance requirement is waived to encourage exploration and platform engagement.
3. Transaction Compliance:
Transactions that reduce the wallet balance below the required minimum will be automatically declined. Users must ensure their wallet meets the minimum balance after any withdrawal or transfer.
4. Emergency Breach Allowance:
Users may be allowed to breach the minimum balance by up to 10% once per calendar month as an emergency buffer. This allowance resets monthly and is subject to the platform’s discretion.
5. Violation of Balance Requirements:
If a wallet falls below the required minimum due to unforeseen circumstances, trading and withdrawal functionalities will be temporarily suspended until the balance is restored.
6. Incentives for Maintaining Higher Balances:
Users who consistently maintain balances above the required minimum may be eligible for loyalty rewards, reduced fees, or enhanced platform benefits.
7. Notification Policy:
The platform will notify users when their wallet balance approaches the minimum threshold or when a transaction risks non-compliance.
8. Changes to This Rule:
Mars Platform reserves the right to update the minimum balance requirements. Users will be notified of any changes at least 30 days in advance via email or platform notifications.
15. Termination
User-Initiated Termination: You may terminate this agreement at any time by deactivating your account and discontinuing use of the Services.
Mars Platform-Initiated Termination: We reserve the right to suspend or terminate your account or access to the Services, with or without notice, if we determine that you have violated these Terms, created risk or possible legal exposure for us, or if your account becomes inactive for an extended period. In such cases, sections pertaining to Privacy, Content License, Limitation of Liability, and Dispute Resolution shall continue to apply.
16. Disclaimers and Limitation of Liability
Services Provided “AS-IS”: Your use of the Services is at your sole risk. The Services are provided “AS IS” and “AS AVAILABLE” without warranty of any kind, express or implied. Mars Platform, LLC, and its affiliates disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability: To the maximum extent permitted by law, Mars Platform and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, resulting from your use of or inability to use the Services. In no event shall Mars Platform’s total liability exceed the greater of one hundred U.S. dollars (U.S. $100.00) or the amount paid by you in the past six months for the Services giving rise to the claim.
17. Governing Law and Dispute Resolution
Governing Law: These Terms are governed by the laws of the State of Georgia, without regard to its conflict of laws principles. Any dispute related to these Terms or the Services shall be resolved exclusively in the federal or state courts located in Valdosta, Georgia.
Arbitration: In the event of a dispute, both parties agree to attempt mediation or arbitration prior to filing any legal claims in court, except where required by law.
18. Changes to These Terms
Mars Platform reserves the right to revise these Terms at any time. Any changes will be effective immediately upon posting. We will attempt to notify users of significant updates; however, continued use of the Services after updates constitutes acceptance of the revised Terms.
